TPS for Ukraine Goes Into Effect on April 19, 2022

The TPS designation of Ukraine enables nationals of Ukraine and individuals having no nationality who last habitually resided in Ukraine, and who have continuously resided in the United States since April 11, 2022, to file initial applications for TPS. The FRN provides instructions for applying for TPS and an EAD. TPS applicants must meet all eligibility requirements and undergo security and background checks.
TPS designation for Ukraine will go into effect on April 19, 2022, and individuals must also prove their continuous physical presence in the United States since the designation date. The FRNs explain the procedures necessary for an individual to submit an initial registration application under the designations and to apply for an EAD or an Employment Authorization.

Filing InformationUSCIS offers the option to applicants for TPS under Ukraine's designation to file Form I-821 and related requests for EADs online or by mail. When filing a TPS application, applicants can also request an EAD by submitting a completed Form I-765, Request for Employment Authorization, with their Form I-821.
Online filing: Form I-821 and I-765 are available for concurrent filing online.[50] To file these forms online, you must first create a USCIS online account.[51]
Mail filing: Mail your application for TPS to the proper address in Table 1.

Mail your completed Application for Form I-821, Temporary Protected Status and Form I-765, Application for Employment Authorization, Form I-912, Request for Fee Waiver, if applicable, and supporting documentation to the proper address in Table 1.TravelTPS beneficiaries may also apply for and be granted travel authorization as a matter of discretion. You must file for travel authorization if you wish to travel outside the United States. If granted, travel authorization gives you permission to leave the United States and return during a specific period. To request travel authorization, you must file Form I-131, Application for Travel Document, available at www.uscis.gov/​i-131. You may file Form I-131 together with your Form I-821 or separately. When filing the Form I-131, you must:
  • Select Item Number 1.d. in Part 2 on the Form I-131; and
  • Submit the fee for the Form I-131, or request a fee waiver, which you may submit on Form I-912, Request for Fee Waiver.


If you are filing Form I-131 together with Form I-821, send your forms to the address listed in Table 1. If you are filing Form I-131 separately based on a pending or approved Form I-821, send your form to the address listed in Table 2 and include a copy of Form I-797 for the approved or pending Form I-821.Biometric Services Fee for TPSBiometrics (such as fingerprints) are required for all applicants 14 years of age and older. Those applicants must submit a biometric services fee. As previously stated, if you are unable to pay the biometric services fee, you may request a fee waiver, which you may submit on Form I-912, Request for Fee Waiver. If necessary, you may be required to visit an Application Support Center to have your biometrics captured. Emergency Assistance by USCIS: Tornadoes in KY, AR, IL, MO

On December 13, 2021, USCIS reminded the public that they offer immigration services that may help people affected by unforeseen circumstances such as natural disasters. Examples of unforeseen circumstances include, but are not limited to, the recent tornadoes in Kentucky and surrounding states.
The following measures may be available on a case-by-case basis upon request:
  • Changing a nonimmigrant status or extending a nonimmigrant stay for an individual currently in the United States. Failure to apply for the extension or change before expiration of your authorized period of admission may be excused if the delay was due to extraordinary circumstances beyond your control;
  • Re-parole of individuals previously granted parole by USCIS;
  • Expedited processing of advance parole requests;
  • Expedited adjudication of requests for off-campus employment authorization for F-1 students experiencing severe economic hardship;
  • Expedited adjudication of employment authorization applications, where appropriate;
  • Consideration of fee waiver requests due to an inability to pay;
  • Flexibility for those who received a Request for Evidence or a Notice of Intent to Deny but were unable to submit evidence or otherwise respond in a timely manner;
  • Flexibility if you were unable to appear for a scheduled interview with USCIS;
  • Expedited replacement of lost or damaged immigration or travel documents issued by USCIS, such as a Permanent Resident Card (Green Card), Employment Authorization Documents, and Arrival/Departure Record (Form I-94); and
  • Rescheduling a biometric services appointment.
Note: When making a request, please explain how the impact of unforeseen circumstances, such as a natural disaster, created a need for the requested relief. If you lost all forms of evidence in an unforeseen circumstance, include an explanation in your description and a copy of a police report, insurance claim, or other report, if available, to support your request.

F1 International Students Can Apply for an OPT Work Permit Online

On April 12, 2021, USCIS announced that F-1 students applying for optional practical training (OPT) can now file Form I-765, Application for Employment Authorization, ONLINE, if they are filing ONLY under one of these categories:
(c)(3)(A) – Pre-Completion OPT;
(c)(3)(B) – Post-Completion OPT; and
(c)(3)(C) – 24-Month Extension of OPT for science, technology, engineering and mathematics (STEM) students.

OPT is temporary employment that is directly related to an F-1 student’s major area of study.
The option to file Form I-765 online is only available to F-1 students filing Form I-765 for OPT. If an applicant submits Form I-765 online to request employment authorization on or after April 15, 2021, but is eligible for a different employment authorization category, USCIS will deny the application and will not refund the fee.

In Russian: USCIS объявило 04-12-2021, что иностранные студенты, подающие заявления на OPT, по форме I-765, будут иметь возможность подать это заявление онлайн (по почте также можно его подать). Для этого нужно созтаь свой аккаунт на сайте USCIS, заявление и все документы подаются онлайн. Это возможно пока только в 3-х категориях.

Если ошибочно студент подал форму онлайн, но может получить разрешения на работу не как OPT, а по другой категории, то USCIS откажет и не вернет госпошлину.

How to file a VAWA self-petition and apply for a Green Card

Briefly for our clients in Russian:

Q/Вопрос: Как я могу подать петицию на VAWA . Я и мой муж расписаны. Проживали вместе, но как оказалось он не в себе когда пьет. Документы на грин карту мы не подавали. У меня нет ни грин карты ни разрешения на работу.

A/Ответ: Добрый день! Вы можете подать петицию VAWA и также заявление на грин карту, разрешение на работу и на поездки БЕЗ участия мужа (во многих случаях это можно делать одновременно).

Если вы замужем (или развелись в течение 2-х лет перед подачей VAWA self-petition), проживали вместе в США (даже если сейчас вы выехали за пределы США), муж вас обижал/бил/притеснял/оскорблял/совершал другие насильственные действия против вас, вы человек моральный и без судимостей и т.п. -- вы можете подать все заявления вместе в USCIS в отдел VAWA, если ваш муж американский гражданин, и даже если он постоянный житель США (т.к. сейчас категория F2A is current).

Подготовка и подача VAWA petition очень сложный и трудоемкий процесс. Крайне важно предоставить и подать вместе ВСЕ сопроводительные документы и доказательства по делу. ВАВА отличается от других петиций тем, что решение по петиции VAWA принимается БЕЗ интервью, а на основании рассмотрения ваших документов. Консультация и помощь компетентного и опытного адвоката по делам ВАВА очень важны.

F1 to H1B Cap-Gap Status and Work Authorization Extension Valid Only to Sep 30 2018

F-1 students who have an H-1B petition that remains pending on Oct. 1, 2018, risk accruing unlawful presence if they continue to work on or after Oct. 1 (unless otherwise authorized to continue employment), as their “cap-gap” work authorization is only valid through Sept. 30. USCIS may not be able to adjudicate H-1B change of status petitions for all F-1 students by October 1, 2018.

USCIS regulations allow an F-1 student who is the beneficiary of a timely filed H-1B cap-subject petition requesting a change of status to H-1B on Oct. 1, to have his or her F-1 status and any current employment authorization extended through Sept. 30. This is referred to as filling the “cap-gap”, meaning the regulations provide a way of filling the “gap” between the end of F-1 status and the beginning of H-1B status that might otherwise occur. The “cap-gap” period starts when an F-1 student’s status and work authorization expire, and they are extended through Sept. 30, with Oct. 1 being the requested start date of their H-1B employment, unless otherwise terminated or the H-1B petition is rejected or denied prior to October 1, 2018.

While the temporary suspension of premium processing of certain types of H-1B petitions has allowed USCIS to prioritize the adjudication of these cap-gap cases, if a cap-gap H-1B petition remains pending on or after October 1, 2018, the F-1 student is no longer authorized to work under the cap-gap regulations. However, the F-1 student generally may remain in the United States while the change of status petition is pending without accruing unlawful presence, provided they do not work without authorization. If an F-1 student with a pending change of status petition has work authorization (such as an I-765 with valid dates) that extends past Sept. 30, they may continue to work as authorized.

On a discretionary basis and upon request, USCIS offers the following immigration services that may help people affected by unforeseen circumstances: 

--Changing a nonimmigrant status or extending a nonimmigrant stay for an individual currently in the United States. 
--Expedited processing of advance parole requests;

Automatic Termination of OPT and Work Permit for F-1 Students If They Transfer to a Different School or Begin Study at Another Level

Automatic Termination of Optional Practical Training (OPT) and Work Permit for F-1 Students If They Transfer to a Different School or Begin Study at Another Educational Level.

USCIS reminds F-1 students on Optional Practical Training (OPT) that transferring to another school or beginning study at another educational level (for example, beginning a master’s program after completing a bachelor’s degree) automatically terminates their OPT as well as their corresponding work permit or employment authorization document (EAD). 

Although authorization to engage in OPT ends upon transferring to a different school or changing educational level, students in F-1 status will not be otherwise affected as long as they comply with all requirements for maintaining their student status. These requirements include not working with a terminated EAD, because termination means that students are no longer authorized to work in the United States. Working in the United States without authorization has serious immigration consequences, including removal from the country and bars on reentry. Furthermore, remaining in the United States in violation of lawful nonimmigrant status could lead to an accrual of unlawful presence which includes another set of penalties under the Immigration and Nationality Act.

Currently, U.S. Immigration and Customs Enforcement’s (ICE) Student and Exchange Visitor Program (SEVP) informs USCIS of the termination date, and the OPT termination is automatic under current regulations. USCIS has updated its systems and will begin to enter the EAD termination date into these systems after being notified by SEVP. USCIS will notify affected students and provide them with an opportunity to correct any errors in the record via their designated school official (DSO). This process is intended to strengthen the integrity of the F-1 and OPT programs, to ensure consistency between SEVP and USCIS systems, and to inform students of possible consequences of working with a terminated EAD.

USCIS Will Destroy Undeliverable Green Cards, Work Permits After 60 Days

NEWS from USCIS: Starting April 2, 2018, USCIS will destroy Permanent Resident Cards (Green Cards), Employment Authorization Cards (Work Permits) and Travel Documents returned to USCIS as undeliverable by the U.S. Postal Service after 60 business days, if USCIS is not contacted by the document’s intended recipient (applicant) to provide the correct address.

Update from USCIS: Начиная с 2 апреля 2018, USCIS будет уничтожать грин карты, разрешения на работу и на поездки за границу, если эти документы были возвращены в USCIS почтой как "недоставленные" (undeliverable), если заявитель не свяжется с USCIS, и не предоставит свой новый или правильный адрес в течение 60 дней после возврата документов почтой.

USCIS Started Accepting Credit Card Payments for Many Applications

​On February 14, 2018, USCIS announced that it will now accept credit card payments for filing most of its applications, including I-130, I-129F, I-485, I-765, I-131, I-601, I-90, N-400, N-600, etc.

Currently, credit card payment option is available for the 41 fee-based forms processed at USCIS Lockbox facilities. To pay by Visa, MasterCard, American Express or Discover, applicants will need to use USCIS Form G-1450. 


USCIS will enter credit card data into the Pay.gov system, operated by the U.S. Department of the Treasury, and will then destroy the Form G-1450 to protect the credit card information.

Applicants for naturalization, N-400, and applicants renewing or replacing their Green Cards, I-90, can already use a credit card if they file online at uscis.gov.

Second DACA Injunction: DACA Renewal Applications Still Accepted

In the second injunction that blocks the Trump administration efforts to end DACA, Judge Nicholas Garaufis of the Eastern District of New York on Feb. 13, 2018 ordered U.S. Citizenship and Immigration Services to accept certain DACA applications while litigation continues.

The ordered relief mirrors the preliminary injunction issued by Judge William Haskell Alsup in the Northern District of California on Jan. 9. It required USCIS to resume accepting DACA renewal applications from people who had previously been granted that relief. This second nationwide injunction similarly requires the Department of Homeland Security to maintain the DACA program on the same terms and conditions that existed before the administration on Sept. 5, 2017, issued a memo to rescind DACA, with the following exceptions:
  • DHS need not consider new applications from individuals who have never before held DACA
  • DHS is not required to provide advance parole to DACA beneficiaries
  • DHS retains the discretion to adjudicate DACA renewal requests on a case-by-case, individualized basis.
The Department of Justice  has requested that the U.S. Supreme Court review Alsup’s order on its merits, bypassing the usual process of appealing to 9th U.S. Circuit Court of Appeals. As early as Feb. 16, 2018, the Supreme Court could announce a decision to review the injunction.

While the injunctions remain in place, USCIS has advised people who have previously received DACA that they may request renewal by filing the following forms:
  • Form I-821D
  • Form I-765, and
  • I-765 Worksheet
Applicants whose DACA expired on or after Sept. 5, 2016 may file as renewal requestors. Applicants who previously held DACA and whose DACA expired before Sept. 5, 2016 may file as initial requestors. Applications from those who have never received DACA will be NOT be accepted, nor will applications requesting advance parole.

DACA policy will be operated on the terms in place before Sept. 5, 2017.

Omaha, Nebraska City Council Supports DACA and Dreamers

The Omaha City Council (Omaha, Nebraska) approved a resolution today, on October 17, 2017, urging the U.S. Congress to act swiftly to protect "Dreamers", students protected by DACA (Deferred Action for Childhood Arrivals program).

The vote was 5-0, with two council members not voting.
​
Nebraska Republican Congressman Don Bacon submitted a letter in support of the resolution, saying he is committed to protecting law-abiding DACA youth from deportation.

This is good news for Omaha area DACA protected young people whose protection is set to expire on March 6, 2018, six months after September 6, 2017 announcement by the White House of their rescission of DACA program.

Городской совет города Омаха штата Небраска единогласно проголосовал сегодня за то, чтобы ходатайствовать Конгресс США о восстановлении недавно отмененной программы DACA, которая предоставляла защиту от депортации, разрешение на работу, номер соцстрахования, возможность получить водительские права молодежи, которые называются "Мечтатели", Dreamers. Президент отменил эту программу 6 сентября 2017, и дата закрытия программы 6 марта 2018.

Это хорошие новости для молодежи в городе Омаха, у которых был или есть статус DACA.

Employment-Based Adjustment of Status Interviews: New Interview Requirement Effective October 2, 2017

​On September 28, 2017, the USCIS Office of the Ombudsman hosted a teleconference call that offered more details about the new personal interview requirements for employment-based adjustment of status applicants.

USCIS confirmed that only cases filed before March 6, 2017 will be adjudicated by the USCIS Service Centers (not local offices) under prior procedures without requiring an interview.

The new interview requirement is being rolled out nationwide, with interviews starting on October 2, 2017 due to President's March 6th 2017 Executive Order.

Each family member, including children, will be asked to appear at a USCIS local office for an interview. 

USCIS indicated it might consider waiving appearances for children under age 14. Each applicant must appear for screening and questioning concerning the underlying immigrant petition (I-140 Petition), which  would have adjudicated prior to forwarding to the local offices for adjustment of status interviews.

USCIS said that adjudicating officers may still question the bona fides and validity of the underlying I-140 petition, even if approved, maintenance of lawful status in the U.S, job portability issues, in addition to newly implemented security features.

Как следует из Указа Президента от 6 марта 2017 г, USCIS Иммиграционная Служба США уже 2 октября 2017 начала назначать интервью на грин карту для тех категорий заявителей, которые ранее не вызывались на интервью, а именно, в области рабочей иммиграции (или иммиграции через работодателя).

В ходе телеконференции 28 сентября, сотрудники USCIS объяснили некоторые детали:

- заявления поданные ДО 6 марта 2017 будут утверждены БЕЗ интервью.
- заявлениа поданные ПОСЛЕ 6 марта 2017 будут требовать интервью.
- дети тоже будут приглашаться на интервью
- USCIS оставляет за собой право не вызывать на интервью детей младше 14 лет
- по новой процедуре петиция работодателя, I-140, будет утверждаться в Service Center, и только заявление на грин карту, I-485, будет рассматриваться офицером в местном офисе, НО этот офицер будет иметь право задавать вопросы по уже утвержденной петиции, в том числе, касающиеся таких моментов как предложение от работодателя о постоянном трудоустройстве, все предыдущие смены работодателя, поддержание легального статуса всеми членами семьи и отсутствие нарушений иммиграционного законодательства (например, работа без разрешения), а также новые требования к национальной безопасности.

New Form I-765 Application for Employment Authorization EAD: Can Request SSN Simultaneously

Today, on October 2, 2017, USCIS made an announcement of a new revised form I-765, Application for Employment Authorization (work permit).

If you file a new revised form I-765, edition date 07-17-2017, you can request the SSA to issue you a SSN. Applicants who receive their approved EAD (work permit) from USCIS should receive their Social Security card from SSA within the following two weeks, which would help to save time. Filing fee remains the same.

The revised USCIS form includes additional questions that allow applicants to apply for an SSN or replacement card without visiting a Social Security office. Starting today, USCIS will transmit the additional data collected on the form to the SSA for processing.

Сегодня, 2 октября 2017, Иммиграционная служба USCIS опубликовала обновленную форму, заявление на разрешение на работу, Form I-765. Дата новой формы 07-17-2017.

Старая форма будет приниматься до 4 декабря. После 4 декабря 2017 только новая форма будет приниматься USCIS.

Преимущество новой формы, которую сегодня уже поместили на вебсайте, заключается в том, что заявитель одновременно подает также заявление на карточку соцстрахования, SSN, и через две недели после утверждения разрешения на работу, заявителю пришлют карточку соцстрахования, что поможет получить карточку и начать работать намного быстрее.

Rescission of DACA Deferred Action for Childhood Arrivals Immigration Program: Sep 5 2017

On September 5, 2017, on behalf of the President and current White House administration, the U.S. Attorney General formally announced the end by rescission of the 2012 immigration deferred action program known as Deferred Action for Childhood Arrivals ("DACA").

DACA did not confer any legal immigration status nor it was a path to the U.S. citizenship. DACA provided protection from deportation and work permits and advance parole/travel documents to approximately 800,000 young, undocumented immigrants brought to the U.S. as children from deportation and provided them with legal work authorization. his is disheartening to youth who have contributed so much both economically and culturally.

The U.S. Department of Homeland Security ("DHS") and USCIS will stop processing any initial DACA accepted at the USCIS office after September 5, 2017.

Any applications already accepted by this date will be processed. DHS/USCIS indicated that current beneficiaries of DACA will not be impacted before March 5, 2018, so "Congress can have time to deliver on appropriate legislative solutions."

DHS has also announced that it plans to continue to accept DACA renewal applications for any DACA beneficiary whose status expires between September 5, 2017 and March 5, 2018, so long as these applications are accepted by October 5, 2017. Any applications received after October 5 will be rejected. 

Note: if your DACA work permit expires after March 5th 2018, you will not be able to renew it for additional two years, as those who can apply to renew IF their work permit expires before March 5th 2018.

In addition, DACA recipients whose valid employment authorization document is lost, stolen or destroyed may still request a replacement through the normal process.

Important: USCIS will no longer adjudicate advance parole request associated with DACA, any applications for advance parole that are currently pending will be administratively closed and filing fees refunded.

US Citizenship and Immigration Services says that information provided in support of the application will not be proactively provided to Immigration and customs Enforcement (ICE) or to Customs and Border Protection (CBP) for the purpose of immigration enforcement proceedings, unless the requestor meets the criteria for the issuance of a Notice to Appear or a referral to ICE. However, a DHS spokesman stated that if Congress does not act, then DACA beneficiaries would be treated as any other person who is in the country illegally, and therefore, subject to deportation or removal.

Additionally, all of the information provided to the government by DACA applicants will remain in the DHS system.

5 сентября 2017 Генеральный прокурор США заявил об окончании федеральной программы ДАКА, которая вступила в силу в 2012 году во время предыдущей администрации. По этой программе около 800,000 молодых людей получили разрешение на работу, поездки за границу и временную защиту от депортации.

ДАКА заявления поданные до 5 сентября 2017 будут рассмотрены, и утверждены, если соответствуют требованиям программы.

Заявления на продление разрешения на работу, находящиеся на рассмотрении на 5 сентября 2017, также будут рассмотрены.

Заявления на продление разрешения на работу, которое истекает между 5 сентября 2017 и 5 марта 2018, будут приняты и рассмотрены, если заявление на продление получено в иммиграционной службе ДО 5 октября 2017. То есть остался только месяц!

Помните, что если ваше разрешение на работу истекает после 5 марта 2018, вы уже не сможете его продлить на два года, как те, у кого они истекает до 5 марта 2018.

Заявления на разрешение на поездки за границу (advance parole) рассматриваться и утверждаться не будет.

Правительство заявило, что информация о молодых людях, подавших заявление ДАКА, не будет передаваться в соответствующие органы на депортацию (пока), но в будущем, если Конгресс не примет нового закона о защите иммигрантской молодежи, иммиграционная служба будет рекомендовать их на депортацию, так же как и всех других категорий лиц, проживающих в США нелегально.

New Updated Form I-9 Must Be Used After September 17, 2017

United States Citizenship and Immigration Services (USCIS) recently published a revised Form I-9, Employment Eligibility Verification, that employers must use to verify identity and employment authorization of all new hires, edition date July 17, 2017.

While there are no substantive changes to the current I-9 Form (because it was recently updated in November 2016), employers are urged to use the new Form I-9 as an opportunity to offer I-9, E-Verify and anti-discrimination training and for the purpose of assessing their state of immigration compliance.
The current (previous) I-9 form may be used until September 17 2017. As of September 18, the only acceptable I-9 form is the one with the revision date of 7/17/17.

The new form updates:
  • Updated name of the Office of Special Counsel for Immigration Related Unfair Employment Practices (OSC) to Immigrant and Employee Rights Section (IER).
  • Form I-9 clarification regarding the timing by which individuals hired must present a completed I-9 form from "by the end of the first day of employment" to "by the first day of employment." Employers may therefore wish to revisit their own I-9 policies and procedures to ensure that section 1 of the I-9 Form is completed no later than when the employee starts work for pay.
  • List C acceptable documents have been revised to include Form FS-240, a Consular Report of Birth Abroad, which is issued by the Department of State to certain individuals born abroad to a U.S. citizen parent. Although this form had previously been in use, the revision should assist employers who were previously told it was not an acceptable document to establish employment authorization. Further, USCIS combined all forms issued by the Department of State that report a birth into one section.
  • USCIS has updated the M-274 I-9 Handbook to reflect the Form I-9 updates. Further, USCIS has issued a handbook in a new online format in addition to their PDF version. The online format also provides a selectable table of contents allowing the reader to select a chapter or subsection, including a 'Table of Changes" section.

New Green Card and Work Permit EAD Design Effective May 1, 2017

USCIS announced a redesign to the Permanent Resident Card (aka a Green Card) and the Employment Authorization Document (EAD). USCIS will begin issuing the new cards on May 1, 2017.

NEW the Redesigned Cards will:
  • Display the individual’s photos on both sides;
  • Show a unique graphic image and color palette:
  • Green Cards will have an image of the Statue of Liberty and a predominately green palette;
  • EAD cards will have an image of a bald eagle and a predominately red palette;
  • Have embedded holographic images; and
  • No longer display the individual’s signature.

Also, Green Cards will no longer have an optical stripe on the back.

Some Green Cards and EADs issued after May 1, 2017, may still display the existing design format because USCIS will continue using existing card stock until current supplies are depleted. Both the existing and the new Green Cards and EADs will remain valid until the expiration date shown on the card.

Начиная с 1 мая 2017, иммиграционная служба США начнет выдавать грин карты и разрешения на работу нового образца. Изменения сделаны с целью сделать федеральные документы более защищенными от подделок. 

Новые грин карты и разрешения на работу будут другого цвета, подпись с карточки уберут, оптическую полоску уберут с грин карты, фото будет на обоих сторонах грин карты и т.п. 

Если после 1 мая вы получите грин карту или разрешение на работу старого образца, не волнуйтесь, они тоже действительны до конца срока действия документа. Таким образом USCIS избавляются от запасов карточек старого образца перед тем как начать использовать карточки нового образца.

H-1B Work Visa New USCIS Policies April 3 2017: Computer Programming, Fraud Detection

There have been several important announcements and policy changes concerning H-1B work visa.

First: On April 3, 2017, USCIS announced that it would introduce several new measures with intent of detecting and deterring H-1B visa fraud and abuses.  According to an official USCIS press release, USCIS will be conducting site visits to H-1B petitioners and worksites, where

(i) USCIS cannot validate the employer’s basic information through commercially available data;
(ii) H-1B dependent employers (companies with high ratio of H-1B workers as compared to U.S. workers: companies with 25 or fewer full-time employees, more than 7 H-1B workers; companies with 26-50 full-time employees, more than 12 H-1B employees; and companies with 50 or more full-time employees, 15% or more H-1B employees); and,
(iii) employers petitioning H-1B workers who work off-site. 

The site visits have been around since 2009. It's not something new. USCIS emphasized that these site visits will be random and unannounced, and are meant to identify companies that abuse the H-1B system. 

USCIS established an email address, which allows the public to submit tips, alleged violations and other information about potential H-1B abuse. The employers that are reported via this email address will also become targets for site investigations.

Second: 

On March 31, 2017, the U.S. Citizenship and Immigration Services (“USCIS”) issued a new Policy Memorandum made available April 3, 2017, which rescinds the December 22, 2000 memorandum titled “Guidance memo on H1B computer related positions.”

The new policy implements a significant change to the adjudication of H-1B petitions for computer programming positions.

2017 H1B Policy Changes and Updates:  The December 22, 2000 memorandum titled “Guidance memo on H-1B computer related positions” provided the policy that most computer programmers had a bachelor’s degree or higher based on information provided by the Occupational Outlook Handbook (“OOH”), which is published by the Department of Labor.  Petitioners were usually able to meet their burden of proving a particular position is a specialty occupation, if it were to prove through information provided in the OOH that a baccalaureate or higher degree is normally the minimum requirement for entry into the particular position.  By rescinding the policy, USCIS has stated that the OOH is no longer sufficient evidence to prove a particular position in computer programming is a specialty occupation and has thus drastically changed how H-1B petitions for computer programmers are to be adjudicated.

Petitioner's Burden of Proof:  The consequence of rescinding the “Guidance memo on H1B computer related positions” is that USCIS has heightened the burden for petitioners.  Petitioners may not rely solely on the OOH to prove that a position in computer science is normally required. Rather, USCIS has clarified its position that petitioners must provide additional evidence to establish that the particular position is a specialty occupation as defined by 8 CFR 214.2(h) (4) (ii) for computer programming.

Entry-Level Positions in Computer Related Positions: The Policy Memorandum clarifies that USCIS must determine whether the attestations and content of the LCA correspond to and support the H-1B visa petition. A petitioner’s designation that a position is a Level I, entry-level position “would likely contradict a claim that the proffered position is particularly complex, specialized, or unique compared to other positions within the same occupation.”  USCIS is changing a long established tradition, by clarifying that most entry-level positions are not specialized occupations within the computer programmer occupation. This provides a basis to deny many of the now pending petitions, filed in April 2017 for the FY 2018. 

Put American Workers First Approach in Tech Companies:  It appears restricting H-1B visas is part of the current administration’s attempt to “put American workers first.” As technology continues to grow, the job of a computer programmer was in the top 5 H-1B job titles for the FY 2017 H-1B petitions.  

Last Minute Policy Change Published on the First Day of the FY 2018 Filing Period for H-1B: The Policy Memorandum is dated March 31, 2017, but only made available April, 3, 2017, as a result, many of the new H-1B petitions have already been filed following the long-established standards of the now “outdated” USCIS 2000 guidance memo.  Employers can now expect to receive RFE (Requests for Evidence) questioning eligibility and requesting additional documentation, and many petitions can be denied.

USCIS allows only 5 days a year in April to file new, cap-subject H-1B petitions for the next fiscal year. In 2016 for FY 2017, 236,000 H-1B visa applicants competed for the 85,000 quota available annually.

USCIS Reissues I-797 Receipts for I-765 Application for a Work Permit Filed Between July 21 2016 and January 16 2017

On February 24, 2017 USCIS announced that they are re-issuing and mailing new receipts to applicants for a work permit EAD. No need to worry if you receive a second receipt, USCIS Form I-797. It's to notify you that your old expired work permit or EAD was automatically extended for additional 180 days if you filed I-765 while your previous EAD was still valid. This applies to applications filed after July 21, 2016 and before January 16, 2017. Applications filed after January 17, 2017 already receive a new form of I-797 extending EAD for 180 days.

USCIS Release Date: February 24, 2017

Starting February 16, 2017, USCIS began reissuing receipt notices (Form I-797) to individuals who applied to renew their Employment Authorization Document (EAD) between July 21, 2016 and January 16, 2017, and whose applications remain pending in the following categories: 
  • (a)(3) Refugee
  • (a)(5) Asylee
  • (a)(7) N-8 or N-9
  • (a)(8) Citizen of Micronesia, Marshall Islands, or Palau
  • (a)(10) Withholding of deportation or removal granted
  • (c)(8) Asylum application pending
  • (c)(9) Pending adjustment of status under section 245 of the Immigration and Nationality Act
  • (c)(10) Suspension of deportation applicants (filed before April 1, 1997), cancellation of removal applicants, and special rule cancellation of removal applicants under NACARA
  • (c)(16) Creation of record (Adjustment based on continuous residence since January 1, 1972)
  • (c)(20) Section 210 Legalization (pending Form I-700)
  • (c)(22) Section 245A Legalization (pending Form I-687)
  • (c)(24) LIFE Legalization
  • (c)(31) VAWA self-petitioners
On January 17, 2017, USCIS began automatically extending expiring EADs for up to 180 days for renewal applicants in these categories. However, some of the receipt notices that USCIS sent out before that date did not contain the applicant’s EAD eligibility category. Therefore, the reissued receipt notices will contain: 
  • The applicant’s EAD eligibility category;
  • The receipt date, which is the date USCIS received the EAD renewal application and which employers must use to determine whether the automatic EAD extension applies;
  • The notice date, which is the date USCIS reissued the receipt notice; and
  • New information about the 180-day EAD extension.  
Applicants may present the reissued receipt notice with their expired EAD to their employer as a List A document for the Form I-9, Employment Eligibility Verification, to show that they are authorized for employment.      
Applicants with an EAD based on Temporary Protected Status (TPS) who filed their EAD renewal applications before January 17, 2017, already received a 6-month extension through the Federal Register notice that extended their country’s TPS designation. Therefore, these applicants will not receive a reissued receipt notice. Please visit the Temporary Protected Status page for current information on each TPS designation. All renewal applicants who file Form I-765 applications on or after January 17, 2017, including TPS renewal applicants, will be receiving Form I-797 receipt notices that contain eligibility category information and information about the 180-day EAD extension.

Это делается потому, что по новым правилам, если вы подали заявление на продление разрешения на работу до истечения срока действия (после 21 июля 2016 и до 16 января 2017), то его автоматически продлили на 180 дней. NEW EAD I-765V Application for a Work Permit for Abused Spouse of NIV A, G, E-3, H visas

Certain abused nonimmigrant spouses may use new USCIS Form I-765V (edition date 01-19-2017) to request an employment authorization document (EAD).

You may file for employment authorization if you are, or were, the abused spouse of a nonimmigrant who was admitted under INA section 101(a)(15)(A), (E)(iii), (G), or (H) [admitted in A, E-3, G, or H nonimmigrant status], and you either accompanied or followed to join your abusive nonimmigrant spouse.

Please note that this doesn't apply to all nonimmigrants, but only to those whose spouse is A, G, E-3 and H visa holder, and an abused spouse was admitted to the United States on an appropriate dependent visa.


The INA section 106 employment authorization categories are subdivided as listed below:
1. Abused spouse of an A nonimmigrant – (c)(27).
2. Abused spouse of an E-3 nonimmigrant – (c)(28).
3. Abused spouse of a G nonimmigrant – (c)(29).
4. Abused spouse of an H nonimmigrant – (c)(30).


Also, this doesn't entitle an applicant to a future claim to a lawful permanent resident status (aka green card). This is intended to be a temporary work permit only, to allow a foreign national to work, live, get a SSN in USA.

DACA: Current Status and Options, February 2017

President Trump said during his election campaign that he would terminate the DACA program. He has not terminated DACA program yet, so DACA is still available and the government is still accepting and approving DACA initial and renewal applications.

However, the DACA program could be terminated at any time.

Although the DACA is still currently available, applying now is risky. Initial applications take several months to be processed, so a new application will most likely not be approved before the DACA program is changed or terminated. Therefore, you may lose your application $495 fee. Furthermore, you risk exposure to immigration authorities by sending them your personal data. 

DACA Renewals – Recommended for Certain Applicants.

Advance Parole – Not Recommended.

Automatic extension of work permit EAD for 180 days if I-765 filed while previous work permit still valid

On January 17, 2017, a new rule requiring automatic extension of a work permit for additional 180 days after the expiration date was published at Federal Register.

Federal Register: "Finally provide additional stability and certainty to U.S. employers and individuals eligible for employment authorization in the United States, this final rule changes several DHS regulations governing the processing of applications for employment authorization.

First, to minimize the risk of any gaps in employment authorization, this final rule automatically extends the validity of Employment Authorization Documents (EADs or Forms I-766) in certain circumstances based on the timely filing of EAD renewal applications." 


Concurrently, DHS eliminates the regulatory provisions that require adjudication of the Application for Employment Authorization (Form I-765 or EAD application) within 90 days of filing and that authorize interim EADs in cases where such adjudications are not conducted within the 90-day timeframe.

17 января 2017 в Федеральном Регистре были опубликованы изменения в процедуру продления разрешения на работу. Это было сделано бывшей администрацией президента. 

Новое правило установило порядок автоматическое продление срока действия разрешения на работу на 180 дней, пока ваше заявление на продление находится на рассмотрении, учитывая, что подано вовремя до истечения срока действия предыдущего разрешения на работу. 

В соответствии с новым правилом, после подачи заявления в USCIS на продление разрешения на работу, форма USCIS I-765, пока заявление рассматривается, заявителям пришлют по почте форму нового образца (форма I-797), которая будет автоматически продлевать предыдущее разрешение на работу на 180 дней.

USCIS Published a Final Rule: International Entrepreneur Rule

On January 17, 2017, the U.S. Department of Homeland Security (DHS) published a final rule International Entrepreneur Rule or "Startup Parole" to improve the ability of certain foreign start-up founders to begin growing their companies within the United States.

Under this final rule, DHS may use its "PAROLE" authority to grant a "Startup Parole", or a period of authorized stay, on a case-by-case basis, to foreign entrepreneurs who demonstrate that their stay in the United States would provide a significant public benefit through the potential for rapid business growth and job creation.

The new rule effective date is July 17, 2017, which is 180 days after its publication in the Federal Register.

This final rule adds a new section 8 CFR 212.19 to provide guidance with respect to the use of parole for entrepreneurs of start-up entities based upon significant public benefit. 


DHS estimates that 2,940 entrepreneurs will be eligible under this rule annually. Eligible entrepreneurs may be granted a stay of up to 30 months, with the possibility to extend the period by up to 30 additional months if they meet certain criteria, in the discretion of DHS.

Under this final rule, eligibility may be extended to up to three entrepreneurs per start-up entity, as well as spouses and children. Entrepreneurs granted stays will be eligible to work only for their start-up business. Their spouses may apply for work authorization in the United States, but their children will not be eligible.An applicant would need to demonstrate that he or she meets the following criteria to be considered under this rule:
  • The applicant possesses a substantial ownership interest in a start-up entity created within the past five years in the United States that has substantial potential for rapid growth and job creation.
  • The applicant has a central and active role in the start-up entity such that the applicant is well-positioned to substantially assist with the growth and success of the business.
  • The applicant can prove that his or her stay will provide a significant public benefit to the United States based on the applicant’s role as an entrepreneur of the start-up entity by:
    • Showing that the start-up entity has received a significant investment of capital from certain qualified U.S. investors with established records of successful investments;
    • Showing that the start-up entity has received significant awards or grants for economic development, research and development, or job creation (or other types of grants or awards typically given to start-up entities) from federal, state or local government entities that regularly provide such awards or grants to start-up entities; or
Showing that they partially meet either or both of the previous two requirements and providing additional reliable and compelling evidence of the start-up entity’s substantial potential for rapid growth and job creation.

Стартап Пароль или Виза на 30 месяцев для предпринимателей в США.
17 января 2017, Иммиграционная служба США (USCIS / DHS) опубликовала новый Закон по поощрению предпринимательства и стартапов в США.

Иностранным бизнесменам и предпринимателям открывающим новый бизнес в США (и членам семей - супругам и детям) будет предоставлятся Пароль (разрешение на въезд и проживание в США сроком на 30 месяцев с продлением, разрешение на работу для предпринимателя и его супруга(-и), но не детей).

Закон вступает в силу 17 июля 2017 года.

Новый статус Пароль для предпринимателей стартапа будут доступен лицам, чьи стартапы были сформированы в течение последних 5 лет, при условии что данный инвестор продолжает играть в нем “центральную и активную роль”. 

Одна стартап компания сможет получить пароли не более, чем на 3-х своих иностранных учредителей (плюс члены их семей). 

Супруги предпринимателя
будут иметь право подать заявление на разрешение на работу, и смогут работать в любом бизнесе или организации, а не только в стартапе. Сам предприниматель имеет право только руководить и работать в своем стартапе. Дети предпринимателя не имеют право на работу, находясь в США по этому паролю.

Госпошлина в USCIS за подачу заявления на такой Пароль составит US$1,200.

Предприниматель должен владеть не менее чем 10% от стартапа, при этом показать, что стартап имеет потенциал для быстрого роста и создания новых рабочих мест. Это показывается:

А) наличием американского инвестора, который инвестировал от US$250,000 в стартап, или
В) получением государственных грантов от US$100,000; или
С) частично # А или # В выше с предоставлением "убедительных доказательств", что стартап обеспечит «значительный положительный эффект для общества" в США.

Предприниматель сможет продлить Пароль по истечении 30 месяцев, если он докажет, что стартап создал как минимум 5 рабочих мест, соответствующим требованиям закона, и его доля в стартапе не упала ниже 5 процентов.
